隱私權政策

Piaggio & C. S.p.A. (辦公室地址登記於Viale Rinaldo Piaggio, 25, 56025, Pontedera (PI), Italy (下稱「我們」或「資料控管者」)是以資料控管者身分蒐集與處理您個人資料的公司。

資料控管者已根據GDPR第37條任命Piaggio集團資料保護官(下稱「集團DPO」)；

您可以隨時透過以下地址與集團DPO聯繫，要求提供與處理您個人資料有關的資訊：

視個案決定且限於下述D)提及之目的範圍內，資料控管者會處理以下類別的個人資料：

• 個人資料(例如：姓名、出生地與出生日期、稅務代碼)；
• 聯絡資訊(例如：地址、電話號碼、電子郵件)；
• 與契約有關的細節(例如：購買的商品及/或服務)；
• 銀行資料；
• 您的肖像。

在您明確同意之前提下，資料控管者僅為了進行客戶服務活動之目的，處理GDPR 第9.1條規定特定類別的個人資料；

最後，我們在此告知您，資料控管者僅在您同意之前提下，透過我們的網站(或「網站」)處理那些可用於提供您所要求的線上服務的地理位置資料。將透過彈出式系統請求您的同意。

1. 提供服務與線上銷售產品 

為了在各種情況下銷售產品或提供服務，得處理填寫網站表格時提供的資料，例：

• • 回覆對產品與服務資訊資料，或是寄送使用與維護手冊(LUM)的自願性要求；
• • 網站提供的產品銷售活動；
• • 處理「試乘」請求；
• • 使您可以存取網站顯示的促銷和優惠；
• • 接受您加入我們社群及訂閱我們電子報的請求；
• • 為您提供我們客戶服務所需的協助；
• • 讓您參加比賽和抽獎。

2. 簽約前活動管理及契約簽署 

為了符合您的要求，以及簽署您與資料控管者之間的契約，我們將利用您的個人資料執行所有必要的簽約前及契約活動。為此，例如，我們可能會與您聯絡，以提醒您契約期限或契約選擇、以您的名義開立發票或其他會計文件。

這些處理目的之法律依據必須遵守您的要求，以及簽署以您為當事人的契約；資料控管者無法在不使用您個人資料的情況下簽訂契約。

3. 遵守法律義務 

為了遵守資料控管者適用之法律義務(例如：稅務、會計、反洗錢)，以及按照主管機關和控制機構給予資料控管者之指示，可能會處理您的個人資料。

此處理目的之法律依據是必須保護資料控管者的合法利益；無法在不使用您個人資料的情況下保護這種合法利益。

4. 統計調查 

我們將利用您的個人資料進行我們內部的統計調查，此為資料控管者之部分商業行為。所進行的統計調查將僅用於內部報告之目的，以利資料控管者改善其產品與服務，以及更有效地管理其客戶檔案及其營運；在任何情況下，此類統計調查之目的均不在直接執行對客戶的營運和活動(例如行銷活動)。

此處理目的之法律依據是保護資料控管者的合法利益；無法在不使用您個人資料的情況下保護這種合法利益。

5. 召回活動 

您的個人資料可能用於您所購買車輛的任何召回行為，例如，若發生任何異常情況時，為了確保您的安全及召回車輛的品質。

此處理目的之法律依據是保護資料控管者的合法利益；無法在不使用您個人資料的情況下保護這種合法利益。

6. 捍衛資料控管者的權利 

若有違反契約或非契約之情形，而有損資料控管者的利益時，我們將使用您的個人資料，在法庭內外捍衛我們權利，例如，如果未在契約約定期限內支付規定總金額，而必須採取可能行動以追償債務時。

此處理目的之法律依據是必須保護資料控管者的合法利益；無法在不使用您個人資料的情況下保護這種合法利益。

7. 類似於已購買產品及/或服務的商業通訊

資料控管者可能專門通過您提供的電子郵件地址，向您發送於您已購買產品與服務類似，且您可能有興趣的促銷和優惠(即所謂的「Soft Spam (客製化行銷訊息)」)。事實上，我們認為您可能有興趣收到您曾表現出興趣的產品與服務的優惠，因此，資料控管者宣傳您已購買的類似產品，對資料控管者的業務需求有利。這類目的之聯繫將只會透過電子郵件進行，而在任何情況下都將保證您可以隨時決定不接收這類通訊。

此處理目的之法律依據是必須保護資料控管者的合法利益；無法在不使用您個人資料的情況下保護這種合法利益。

8. 行銷活動 

在您特別同意的情況下，Piaggio & C. S.p.A.或任命為資料處理者的其他Piaggio集團公司(下稱「子公司」)得直接處理您填入線上表格時所提供、我們零售商及經銷商所蒐集或於貿易展覽會與活動期間所蒐集之個人資料 (即，個人詳細資料、聯絡資訊及有關契約簽訂及/或服務要求的資訊)，以便以寄送廣告資料(含客製化廣告資料)的方式促銷我們的服務與產品，並且邀請您參與我們的計畫與活動、進行市場研究和調查客戶滿意度，以及改善我們的服務。

再者，在徵得您明確且無條件的同意下，我們得出於促銷之目的，將您在Instagram或Facebook帳戶上發布並標注我們社交連結官方標籤的圖像，用於我們的數位通訊中(例如：在我們的社交媒體檔案中分享、發布在我們網站，以及我們用於直接郵寄活動的電子郵件)。

此類處理目的之法律依據是特別向您取得之同意。若您決定不予同意時，將不會因此類目的而處理您的個人資料。

在任何情況下，您未表示同意並不會對您與資料控管者之間簽訂的契約造成任何類型的影響，亦不會為您帶來任何負面後果。 

9. 分析活動 

在您明確同意的前提下，為了分析您的資料並了解您的喜好和習慣，以便提供符合您品味與需求之產品與服務的客製化優惠，資料控管者得直接或透過任命為資料處理者之子公司，處理在線上、貿易展覽會和活動、我們經銷商與零售商所蒐集的您的個人資料。

僅得在取得明確同意後，始得為前述目的處理您的個人資料。如您未表示同意，將不會影響您與資料控管者之間簽訂的契約，亦不會為您帶來任何負面後果。在任何情況下，您都有權隨時撤回先前已給予的同意。

未提供前述D)第1、2、3點所處理之資料，將無法購買我們產品與使用我們服務，而未提供前述D)第7點目的所述之資料，將無法收到類似於您已獲得之我們服務與產品的相關廣告資料。

若您未同意，為前述D)第8與9點之目的處理您的個人資料，將無法收到有關我們服務與產品以及更新我們所籌辦的活動和計畫的廣告資料(含客製化資料)。

在前述D)第8與9點所述的目的下，處理您個人資料之所有情況，都需要您明確的同意。

我們提醒您，您可以隨時撤銷已給予的同意。

在前述D)規定目的之限制下，可將您的個人資料傳送給以下屬於GDPR第28條資料處理者之各類指派人員(若必要)：

• 子公司；
• Piaggio集團零售商及/或經銷商；
• IT系統和網站管理之服務提供商；
• 法律、會計與稅務諮詢服務提供者；
• 資料控管者用於提供所需服務的公司；
• 款項管理之銀行及其他金融機構；
• 監督與控管機關和組織，以及具有公共性質功能的一般公共或私人實體；

您可前往資料控管者的登記辦公室地址，或利用前述B)所示方式聯絡集團DPO，要求您個人資料可能傳送對象之完整更新清單。

在其各自職權範圍內，依據GDPR第29條授權處理個人資料之資料控管者員工、受任或受管理的勞工及合作者將可能知悉您的個人資料。

您的個人資料將不會被揭露。

您的個人資料可能被移轉給成立於非歐盟國家的子公司。

在依GDPR第45條判定的適當性，或採用並簽訂歐盟委員會標準契約條款，規範相關資料控管者與子公司之間關係的基礎下，這項移轉之實施將符合適用法律規定之保證。

只要簡單地利用前述B)資訊提出要求，您即可獲得有關您個人資料移轉的更多資訊。

Piaggio & C. S.p.A. 透過位於義大利的伺服器管理客戶關係管理(或稱「CRM」)系統。Piaggio & C. S.p.a.及子公司按照前述D)規定的方式及目的(包括透過其零售商和經銷商)蒐集關於您的所有資料，將移轉到CRM系統。

Piaggio & C. S.p.A.得為統計之目的，或在您同意下，為行銷及/或分析之目的，處理CRM系統內含之您的個人資料。

為了執行Piaggio集團的廣告/行銷活動，我們將以資料控管者身份處理CRM系統內關於您的個人資料，若有必要，將任命資料處理者作為您的個人資料接收者，用以管理當地市場的行銷活動。

Piaggio & C. S.p.A.向您保證，其已實施所有必要的安全措施，保障CRM系統內含您個人資料的完整性。

無論是否使用電子工具，我們皆會依照正確性、合法性及遵守GDPR第5條所有原則來處理您的個人資料。

在您的同意下，出於分析目的之分析活動會針對您的品味與偏好進行，將始終包含人力介入，並絕不會以完全自動化的方式進行。

將採取適當措施保障您個人資料的安全性和機密性，其中包括防止揭露、未經授權存取、變更和遺失處理過的資訊。

為了適時滿足您的要求、履行所有人適用之法律義務，以及為尋求符合前述D)和以下摘要表所述蒐集目的，而嚴格必要規範之任何個案，將專門保存您的個人資料：

我們在此通知您，在任何情況下，若您在前述期間屆滿時撤回同意，我們將自我們的資料庫內刪除或匿名提及您的所有資訊。

僅利用前述B)資訊提出要求，您即可以行使GDPR第15至22條的權利。

特別是，您得要求資料控管者存取有關您的資料、修改及/或刪除這些資料，並且於GDPR第18條所述情況下限制其處理。

您得隨時以GDPR第21條規定的方式，對處理您個人資料、收到關於您的資訊、及/或將其轉送給其他資料控管者的行為提出異議。

此外，我們提醒您，您得始終以同樣容易的方式撤回已給予的任何同意。

在任何情況下，資料控管者最晚將在行使權利後一個月內，提供您要求的所有資訊及/或對於為了滿足您要求而採取的行動進行通知，不得不當延遲。

只有在明顯未有根據或過多要求及重覆的情況下，資料控管者才會要求您分攤合理費用或是拒絕滿足您的請求。

最後，我們通知您，若您行使前述任何權利，為了確認您的身份，可能會要求您提供特定資訊。

如果您認為我們的處理行為違反了GDPR的規定，您可以向資料保護主管機關(https://www.garanteprivacy.it/web/garante-privacy-en)，或是向您慣常住所、工作或聲稱發生違規之地的歐盟會員國資料保護辦公室提出申訴。

考量到個人資料處理相關法律可能會更新，資料控管者得隨時修改及/或更新本隱私權政策。

將以電子郵件通知您這些若與您相關的變更，並且，在任何情況下，於通知時或在網站和子公司網站發布隱私權政策修改版時，即發生約束力。

According to current legislation in Italy, express consent is not always required for the use of cookies. In particular, no such consent is required for technical cookies, i.e. those used for the sole purpose of carrying out the transmission of a communication over an electronic communications network, or as strictly necessary to provide a service explicitly requested by the user. The Italian Authority for the Protection of Personal Data considers the following cookies as technical cookies, which do not require consent for their use:

Our site also uses profiling cookies that we can only install with your prior consent.

Profiling cookies are designed to create profiles about the Users and are used to send advertising messages in line with the preferences expressed by the User during browsing. These cookies are used to present the best content to the users according to their interests. These types of cookies can be used to display targeted advertisements or to limit the number of times an advertisement is shown. As already envisaged in the banner that immediately appears when first visiting the website, consent to the use of all cookies can be provided by Users by selecting the virtual acceptance key (e.g. an OK, a tick, etc.) or by continuing to browse the website (e.g. ignoring the banner/pop-up and performing further operations).
